Momentum Terms & Conditions
These terms govern your use of the Momentum website and your purchase of products from us. By using our site, creating an account, or placing an order, you agree to them — so it’s worth reading them once, in plain language, before you buy.
They sit alongside our Warranty Policy, Returns Policy, and Privacy Policy, which form part of your agreement with us. Momentum Electronics (Business Registration No. 320230084313) is the business behind momentumelectronics.store; where these terms say “Momentum,” “we,” or “us,” that’s who we mean, and “you” means the person using the site or placing an order.
1. About These Terms
These Terms & Conditions apply whenever you visit momentumelectronics.store, create an account, or buy from us. By doing any of those, you confirm that you accept these terms. If you don’t agree with them, please don’t use the site or place an order.
We refer to our Warranty Policy, Returns Policy, and Privacy Policy at various points. Those policies are part of your agreement with us, and reading them together gives you the full picture of how we operate.
2. Eligibility
To buy from Momentum or hold an account, you must be at least 18 years old and able to enter into a binding agreement. By placing an order, you confirm that you meet these requirements and that the information you give us is accurate and your own.
3. Your Account
Some features — such as the warranty dashboard and your order history — require a Momentum account. You are responsible for keeping your login details secure and for activity that happens under your account. We provide tools to help you protect it, including two-factor authentication and login notifications, and we recommend using them.
Let us know promptly if you believe your account has been accessed without your permission. We may suspend or close an account where we reasonably believe it is being used for fraud, abuse, or in breach of these terms (see section 16).
4. Products and Pricing
We describe our products as accurately as we can, but small differences in detail, appearance, or specification can occur, and product images are for illustration. Prices are shown in Zambian Kwacha (ZMW) and are inclusive of any taxes we are required to account for.
We work to keep pricing and availability correct, but errors can happen. Where a product is listed at an obviously incorrect price due to a genuine mistake, we are not obliged to honour it — we’ll let you know and give you the choice to reorder at the correct price or receive a full refund of anything already paid (see section 5).
5. Orders and Acceptance
When you place an order, you are making an offer to buy. Your order is accepted, and a contract is formed, only when we confirm that your order has been accepted or dispatched — not simply when you place it or when payment is taken.
We may decline or cancel an order before that point — for example, if a product is out of stock, if we identify a pricing or description error, if we cannot verify your details, or if we suspect fraud. If we cancel an order you have already paid for, we will refund you in full for that order.
6. Payment
Payment is made through our payment provider, and full payment is required before we dispatch your order, unless we have agreed otherwise in writing. By submitting payment, you confirm you are authorised to use the payment method.
We do not store your full payment credentials; these are handled by our payment provider. If a payment fails or is reversed, we may hold or cancel the related order.
7. Delivery
We deliver within Zambia. Delivery timeframes and any delivery charges are shown during checkout or communicated to you, and are estimates rather than guarantees. Risk in a product passes to you on delivery; ownership passes to you once we have received full payment.
If no one is available to receive a delivery, or the delivery details you gave us are incorrect, additional charges or delays may apply.
8. Warranty
Momentum products are covered by our Warranty Policy, which explains how warranties activate, what is covered and excluded, and how to make a claim. The Warranty Policy forms part of these terms.
9. Returns and Refunds
Returns and the remedies available to you are governed by our Returns Policy. In summary, we do not accept change-of-mind returns, and approved warranty claims are resolved by repair or replacement rather than cash refunds. The Returns Policy sets out the full detail and forms part of these terms.
10. Acceptable Use
When using our site, you agree not to:
- Use it for any unlawful or fraudulent purpose
- Interfere with its security or normal operation
- Attempt to gain unauthorised access to accounts or systems
- Scrape, copy, or harvest data or content without our permission
- Use it in any way that could harm Momentum, other users, or third parties
We may restrict or withdraw access where these rules are broken.
11. Intellectual Property
The Momentum name, logo, branding, site design, text, and other content are owned by Momentum or used under licence, and are protected by law. You may use the site for browsing and buying, but you may not copy, reproduce, or reuse our content or branding for your own commercial purposes without our written permission.
12. Reviews and Submissions
If you submit a review, comment, or other content to us, you are responsible for it, it must be accurate and lawful, and you grant us permission to use and display it in connection with our products and services. We may remove content that is unlawful, misleading, or inappropriate.
13. Limitation of Liability
We stand behind our products and aim to provide a reliable service, but to the extent the law allows, Momentum is not liable for indirect or consequential losses, loss of profit, loss of data, or any loss beyond the value of the product or order concerned. Nothing in these terms excludes or limits any liability or right that cannot be excluded or limited under the laws of Zambia.
14. Privacy
How we handle your personal information is set out in our Privacy Policy, which forms part of these terms and explains what we collect, why, and the rights you have under the Data Protection Act, 2021.
15. Changes to These Terms
We may update these terms from time to time — for example, to reflect changes in our products, processes, or legal obligations. The current version is always published here and applies from its publication date. Continuing to use the site or place orders after a change means you accept the updated terms.
16. Suspension and Termination
We may suspend or close your account, or withdraw access to the site, where you breach these terms, where we are required to by law, or where we reasonably suspect fraud or misuse. Where we do, it does not affect orders or warranty cover already in place, except where the breach relates directly to them.
17. Governing Law and Disputes
These terms are governed by the laws of the Republic of Zambia, and any dispute relating to them or to your purchase falls under the jurisdiction of the Zambian courts. We’d always encourage you to contact us first — most issues are resolved quickly and directly (see section 18).
